HOW WE COLLECT PERSONAL DATA

The following outlines the sources through which we gather Personal Data:

Information Directly Provided by You:

BODII Wearable Devices:

Data is collected through BODII wearable, such as the BODII FLEX. This devices capture information related to your physical well-being, offering insights into aspects like  Range of Motion

Interaction with BODII Services:

Engaging with our BodiiCoach or other interactive features results in the collection of Personal Data. This includes information exchanged during interactions, responses received from the coach, and details shared for optimizing your experience.

Automatic Data Collection:

We utilize automated data collection methods, such as Cookies, local storage objects, web beacons, and similar technologies. We also collect devices and apps that use analytics.Technologies like these enhance your experience and help us understand how you interact with our services, allowing for continuous improvement.

Data from Customers and Partners:

Personal Data may be obtained from customers and partners, including employers, Physiotherapists, or other organizations engaging with our services. This collaborative approach ensures a holistic understanding of your well-being.

Marketing and Advertising Partners:

We collaborate with marketing and advertising partners who may provide us with data related to your interactions with our services, advertisements, or communications. This data enables us to tailor our offerings to better suit your preferences.

PERSONAL DATA WE COLLECT

We collect various types of Personal Data to tailor our services and enhance your experience. Here’s a breakdown of the types of Personal Data we may collect:

Contact Details:  

First and last name, email address, mailing address, and phone number.

Your email address will be used to contact you to directly answer your general enquiry. Our processing basis for this communication is consent, which you will be requested for at the time you submit the form.

We may retain a record of any contact you make with us.

Profile Data:

Username and password data collected directly on the app for your BODII account .

Communications:

Interactions and conversations exchanged with you, including emails, web app, or mobile app communications containing questions, feedback, or reviews.

Wellness Data:

Details about the type and duration of exercise.

Data reflecting strain, recovery, and your physiological profile (birthday, gender identity,      weight, height, fitness/athlete level).

Recovery information related to your specific injury that you choose to share with us.

Metadata on exercise patterns.

Conversations with BodiiCoach:

Information exchanged during interactions with the BodiiCoach, as detailed in Section 8 of our policy.

Payment and Transactional Data:

Information needed to complete orders, including name, email address, payment card information, bank account number, billing information.

Transaction history (Note: BODII does not have access to payment card numbers).

Marketing Data:

Your preferences for receiving marketing communications in future.

Details about your engagement with marketing materials, such as opened emails and clicked links.

Device Data:

Operating system type and version, device manufacturer and model.

Browser type, screen resolution, RAM and disk size, CPU usage.

Device type (e.g., phone, tablet), IP Address, unique identifiers (including those for advertising purposes).

Geolocation Data:

GPS, IP Address, and movement data for certain exercise types with your permission.

How long do we hold data for?

BODII  only retains data for as long as it is strictly required. This means data that you provide through the general contact form is held for no more than 24 months. After this time all stored data will be removed from our live systems in accordance with our data policy.

Who has access to your data?

We won’t share or sell your information or allow the use of your information for marketing from third parties, however we may share relevant information with our suppliers to help us deliver our services to you. BODII will not sell or rent your information to third parties, and we do not share information for marketing purposes with any third parties

Like all other companies, BODII may from time to time receive requests for member data from third parties, like governmental entities (including law enforcement) and private parties engaged in civil litigation. Here are the key principles we stand by when evaluating these requests:

BODII will never voluntarily disclose member data in response to a request by a governmental entity or civil litigant.

BODII  will never provide any governmental entity or civil litigant with direct access to our members data.

BODII will never provide copies of member data held by BODII to any governmental entity or civil litigant without a valid, narrowly tailored, and legally-binding request (e.g., subpoena, warrant or court order).

If BODII receives a request for a member’s data, we will provide notice to the member by sending an email to the email address we have on file for that member.

BODII is prepared to fight to protect our members’ privacy in court if necessary. We will reject, challenge or object to any data access request from a governmental entity or civil litigant that we believe is invalid, overly broad, unclear or otherwise inappropriate.

BODII may share data with 3rd party suppliers working on our behalf – this includes contractors, agents and other subcontractors who work for BODII  to provide services and complete tasks for the delivery of our service. Where such a relationship is in place there are contractual safeguards in place to protect your information. BODII will only share data that is relevant to the tasks being completed and to the delivery of service to you, and where possible the data will be anonymised. None of these organizations and individuals are permitted to use the data for any other purpose.

How will we keep your data secure?

All of our services run over HTTPS using TLS ensuring data transmitted between the application/website and our servers is secure. We take lengths to ensure that the network environment in which the application/website is hosted is kept secure by following best practices and ensuring that security updates are applied in a timely fashion.

How do we support your rights?

At BODII we  believe that you should be in control of your personal data.

We will not contact you for marketing purposes by email unless you have given your prior consent. You can change your marketing preferences at any time by contacting us by email: hello@bodii.uk

The accuracy of your information is important to us. If you change email address, or any of the other information we hold is inaccurate or out of date, please email us at hello@bodii.uk

You have the right to ask for a copy of the information BODII holds about you. We will provide any information free of charge, please email hello@bodii.uk with a copy of a valid ID (passport or driving license).

We never sell our customers personal data. This is our promise.

We will delete your personal data if you ask us to, including if asked when you cancel your membership.

Right to remove consent

Where we rely upon your consent to perform data processing we allow you to revoke the previously granted consent by contacting us at hello@bodii.uk whereupon we will comply with your request.

BODII employees only member personal data when required to provide services and support.

We prioritize the accountability and the security of your personal data. Our policy is that a member’s personal data is not to be accessed or shared by anyone at BODII without an explicit need to do so. 

BODII membership services representatives, management team members, data scientists and technical team members are not permitted to access your personal data without a legitimate business need.

We maintain a log that tells us who has accessed member personal data and when.

We actively evaluate data access logs and investigate any anomalies for data access.

Use of cookies

Like many other websites and apps, BODII uses cookies. Cookies are small pieces of information sent by an organization to your computer or device and stored on your hard drive to allow that website to recognise you when you visit. They collect statistical data about your browsing actions and patterns and do not identify you as an individual. This helps us to improve our website and deliver a better, more personalized service.

BODII COACH & THIRD-PARTY AI TECHNOLOGY

BODII Coach is a generative AI feature that is intended to help you understand and make progress towards your goals, decipher BODII concepts and provide educational guidance, and integrate with the rest of the BODII experience. It uses the ROM(Range of Motion) results collected by the device, your inputted health data and a bank of secondary datasets that we have curated alongside opensource AI.

If you decide to use BODII Coach, please note that BODII Coach leverages third-party AI technology provided by our LLM partner. This technology is trained on real-world data to generate intelligent and personalized responses in conversations with users. Responses from BODII Coach are based on your requests and relevant information collected through your BODII metrics. 

We require our LLM partner to use your anonymized BODII metrics only for the purpose of allowing BODII Coach to generate responses to your chats. We have ensured that our LLM partner has a “Zero-Retention/Zero Training Policy” with respect to your BODII metrics, meaning that our LLM partner will not store or retain any of the anonymized BODII metrics they receive through your use of BODII Coach, and our LLM partner will not use any of the anonymized BODII metrics they receive for training any algorithms or LLM technology.

We will only share your anonymized BODII metrics with our LLM partner. We ask that you refrain from providing any identifying information, such as your name, in conversations with BODII Coach.

BODII may retain the history of your conversations with BODII Coach to ensure you continue to have access to previous conversations while using the feature. When you revisit any topics from previous chats, BODII may share the context of your previous conversations with BODII Coach to create a better experience for you. You may delete your BODII Coach chat data at any time by either tapping the chat icon in BODII Coach to view your conversation history and swipe left on conversations you would like to delete or requesting a deletion through Membership Services.

If you agree to use BODII Coach, please note that consistent with our Privacy Principles, BODII employees will only access member Personal Data when required to provide services and support, which may include collecting information about your experience with BODII Coach to assess the performance of and improve BODII Coach and other product offerings. In the case that BODII Coach suggests connecting to Membership Services, you can opt in and have your support request automatically filed with our team. In this case, they will only have access to that specific conversation to provide you with the best support.

At BODII Technologies Ltd., we respect your privacy and are committed to protecting your personal information. This Privacy Policy describes how we collect, use, and store data when you use our mobile application (“the App”) that receives data from a Bluetooth device related to your physical well-being. Please read this policy carefully to understand our practices regarding your data and how we handle it. By using the App, you consent to the practices described in this Privacy Policy.

Information We Collect

 

 

1.1 Personal Information: The App will collect general information as follows:

 

  • Yourself, when you provide such information directly to us, such as when completing your profile;
  • BODII FLEX Wearable that you wear;
  • The Chat interface when you interact with and receive responses from it;
  • Automatic data collection, such as Cookies, local storage objects, web beacons, and other similar technologies in connection with your use of the Services;

1.2 Device Information: When you use the App, we may collect certain device information automatically, including but not limited to the type of mobile device you use, unique device identifiers, operating system version, and mobile network information.

Data Collection and Use
2.1 Data Collection: The App collects data from the Bluetooth device like basic health data provided by the patient and login information for accounts and along with that your physical well-being, such as location and range of movement. This data is collected solely for the purpose of enabling you to review and track your physical well-being over time.

2.2 Data Usage: The data collected from the Bluetooth device is used to provide you with personalized information, insights, and recommendations related to your physical well-being. It may also be used for research and development purposes to improve our services. All data is stored locally on the App and is not transmitted to our servers unless you explicitly choose to do so.

Data Storage and Security
3.1 Local Storage: The data collected from the Bluetooth device is stored on our databases. We do not store this data on our servers, unless you choose to sync or backup your data to our secure cloud servers.

3.2 Data Security: We implement reasonable security measures to protect the data collected by the App. However, no method of transmission or storage is 100% secure, and we cannot guarantee the absolute security of your data. You understand and acknowledge that any transmission or storage of data is done at your own risk.

Sharing of Information
4.1 Aggregated and Anonymized Data: We may aggregate and anonymize the data collected from the Bluetooth device for statistical and analytical purposes. This aggregated and anonymized data may be shared with third parties for research, marketing, or other purposes. However, this data will not contain any personally identifiable information.

4.2 Legal Requirements: We may disclose your information if required to do so by law or if we believe that such disclosure is necessary to comply with a legal obligation, protect our rights or the rights of others, or investigate fraud or any illegal activities.

BODII Coach & third party AI technology

5.1 The Bodii Coach leverages anonymized BODII metrics (encrypted user data) and basic health data, processed by a third-party LLM partner intellithing.tech, to generate personalized responses during user interactions. 

5.2 Our LLM partner will not store or retain any of the anonymized BODII metrics they receive through your use of BODII Coach, and our LLM partner will not use any of the anonymized BODII metrics they receive for training any algorithms or LLM technology.

5.3 The privacy measures taken by BODII, indicating that only anonymized metrics are shared with the LLM partner, and users are urged to avoid providing identifiable information during conversations with BODII Coach. The retention policy for user conversations, allowing users to delete their chat data at any time.

5.4 If users choose to use BodiiCoach, BODII employees may access member Personal Data only when necessary for providing services and support. The privacy principles of BODII are highlighted, emphasizing the commitment to assessing and improving the performance of BODII Coach and other product offerings while maintaining user privacy. 

Children’s Privacy
The App is not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children. If you become aware that your child has provided us with personal information without your consent, please contact us, and we will take steps to remove the information and terminate the child’s account.

How can I use my rights?

You have several rights concerning your personal data in the BODII App.

7.1 Right to access

You have the right to access your personal data. You can contact the Partner, and they will inform you what personal data they have collected and processed regarding you.

7.2 Right to withdraw consent

Your personal data is disclosed to the Partner if you give consent to it. You can withdraw your consent at any time from your BODII on the web account settings. Instructions on how to withdraw your consent can be found here. If you withdraw your consent, the Partner can no longer access your data. Please note that withdrawing your consent from the Service or changing any other consent settings do not affect the processing of data that the Partner may have extracted from the BODII App service.

7.3 Right to correct

You have the right to have incorrect or incomplete personal data corrected or completed. You can correct or update some of your personal data through your user account settings in the BODII mobile application or BODII on the web account settings.

7.4 Right to erasure

You can ask the Partner to erase the personal data that they have collected about you. Your Partner will comply with such a request unless it has a legitimate ground to not delete the data.

7.5 Right to object

You can object to processing that is based on public interest or legitimate interest of the Partner or by a third party. If the Partner does not have legitimate grounds to continue processing such personal data, it shall no longer process the personal data after your objection. If the Partner processes your personal data for direct marketing purposes, you always have the right to object to such processing.

7.6 Right to restriction of processing

You can request the Partner to restrict processing of personal data, for example, when your data erasure, rectification, or objection requests are pending and/or when the Partner does not have legitimate grounds to process your data.

7.7 Right to data portability

You have the right to receive your personal data from the Partner in a structured and commonly used format. With certain exceptions, you have the right to request the Partner to transmit your data to a third party.

Changes to the Privacy Policy
We reserve the right to modify this Privacy Policy at any time. Any changes will be effective immediately upon posting the updated Privacy Policy on the App. Your continued use of the App after any such changes constitutes your acceptance of the revised Privacy Policy.
